China\u2019s first patent to a Covid-19 vaccine was granted to CanSino Biologics back in <a href=\"https:\/\/uk.reuters.com\/article\/us-health-coronavirus-vaccine-cansino\/china-grants-countrys-first-covid-19-vaccine-patent-to-cansino-state-media-idUKKCN25D09V\">August<\/a>. This case saw the UK Supreme Court hand down a landmark decision on the law of Standard Essential Patents (SEPs) and Fair, Reasonable and Non-Discriminatory (FRAND) licensing practices. Issues surrounding SEPs and FRAND are of particular importance to multinational companies in the telecoms industry. Since the court\u2019s decision was handed down, the case has attracted a great deal of <a href=\"https:\/\/www.mondaq.com\/uk\/patent\/980246\/unwired-planet-v-huawei-supreme-court-rules-on-global-frand-licensing-powers-of-uk-courts\">commentary<\/a>. The UK Supreme Court found that UK courts may set the terms for global FRAND licences to portfolios of declared SEPs.<\/p>\n<h4>The UK pulls the plug on Huawei\u2019s involvement in its 5G network<\/h4>\n<p><img decoding=\"async\" class=\"aligncenter size-full wp-image-7028\" src=\"https:\/\/focus.cbbc.org\/wp-content\/uploads\/2021\/02\/shutterstock_1618533604.jpg\" alt=\"\" width=\"1000\" height=\"667\" srcset=\"https:\/\/focus.cbbc.org\/wp-content\/uploads\/2021\/02\/shutterstock_1618533604.jpg 1000w, https:\/\/focus.cbbc.org\/wp-content\/uploads\/2021\/02\/shutterstock_1618533604-300x200.jpg 300w, https:\/\/focus.cbbc.org\/wp-content\/uploads\/2021\/02\/shutterstock_1618533604-768x512.jpg 768w, https:\/\/focus.cbbc.org\/wp-content\/uploads\/2021\/02\/shutterstock_1618533604-585x390.jpg 585w, https:\/\/focus.cbbc.org\/wp-content\/uploads\/2021\/02\/shutterstock_1618533604-263x175.jpg 263w\" sizes=\"(max-width: 1000px) 100vw, 1000px\" \/><\/p>\n<p>Staying with Huawei, the Shenzhen-headquartered tech giant was at the centre of further <a href=\"https:\/\/www.itpro.co.uk\/mobile\/5g\/356443\/uk-gov-bans-huawei-from-5g-network-in-major-u-turn\">controversy<\/a> in the UK when the UK government confirmed that all Huawei equipment will be removed from the country&#8217;s 5G network by 2027 on national security grounds. Nevertheless, Huawei remains the leader in the 5G patent race, with some commentators estimating that it owns up to 19% of the core 5G standard patents.<\/p>\n<h4>Significant changes to China\u2019s patent laws are announced<\/h4>\n<p>Some of the biggest changes to the Chinese patent system in over a decade were introduced when the <a href=\"https:\/\/www.lexology.com\/library\/detail.aspx?g=da9aa416-f58f-429d-8494-5c3c7272bf8c\">fourth amendment<\/a> to the China Patent Law was approved in October 2020 and will take effect on 1 June 2021. Under the pilot, which lasts for two years, Chinese nationals and residents will be able to select the EPO as the International Searching Authority for English language international patent applications filed at the CNIPA or the World Intellectual Property Office. This pilot may be of particular interest to Chinese entities who are looking to protect inventions in Europe.<\/p>\n<h4>A report into patent infringement cases in China<\/h4>\n<p>Towards the end of 2020, the Beijing Intellectual Property Court (BIPC) released a report on patent infringement cases tried by the BIPC since its creation in November 2014 up to March 2020. The report indicated a year-on-year increase in the number of cases received, with the proportion of patent owners winning their cases being relatively high.
